Tebasan: the shortest form of land-leasing.

In Indonesia, land leasing covers several types of contract depending on the length of time of temporary transfer of the rights to use the land, called tebasan, ijion, sewa and gadai. The tebasan system is a contractual arrangement, whereby a farmer, of any tenurial status, sells the almost ready to harvest standing crop to a marketing agent. This study conducted in East Java describes: the characteristics of tebasan contracts as applied to various crops; reasons why farmers choose this system; and the relationship between crop price (tebasan rent) and area of lease and length of lease. Obtaining immediate money in cash, lack of time and family labour to handle the harvest and postharvest work, and lack of postharvest facilities were among the reasons why farmers chose this system. The policy implication of the study is that the decision on future implementation of the 1960 Basic Land Law dealing with the abolition of all forms of temporary rights transfers of agricultural land should take into account the function of the various forms of land leasing contract including tebasan.
